Never before in recent history has the debate about asylum and refugee status been such a hot-button issue in both political and social circles. As a nation that has always prided itself on being the one to police and take care of the least of humanity, overhauling the ways that we accept people onto the native land is a huge change in political thought and American mentality. At no time in the recent past have there been so many displaced people throughout the world searching for a safe place to call home. Is now really a time to put up the “no entry” sign and to deny people access to the freedoms afforded by American society? There are already legalities in place when it comes to refugee status and asylum. How politics will now determine who is granted asylum going forward could change the policy of acceptance of people from abroad for generations to come.

Although typically assumed to be one and the same, refugee status is very different from asylum.  According to a immigrant attorney, both are allowed to gain residency due to harmful conditions in their homeland, but they have different requirements to gain entry into America. The major differences are:

  • Those seeking asylum are already on American soil, while those who are trying to gain refugee status have not yet made it to America
  • Refugees work through the United Nations to gain a new homeland, and asylum seekers have to petition the US government directly to gain entrance

In both examples, although there are sweeping regulations about how to define refugee and asylum status, each case is determined individually by the specifics presented. Every application is decided upon by the individual’s circumstances. An immigration law officer is ultimately in charge of either accepting or denying each individual petition according to their own judgment.  There are specific criteria dictated by immigration law, but each case is decided upon separately.


When someone seeks asylum in the US, they are already living on American soil and wish to remain here. The applicant must present a compelling case as to why they must stay here for their safety, and show that returning to their native land would put them in harm’s way. They must prove that if they return home, they will face persecution or imprisonment. The following criteria are considered reasons for asylum to the US:

  • Religious fears
  • Racial inequalities
  • Nationality problems
  • Being a member of a social group (like the lesbian or gay community)
  • Their political affiliation or opinion

If you want to seek asylum in the US, there are procedures and limitations. The US requires that to stay on American soil, you have to fill out a petition within one year of arrival. A more involved process, petitioning for asylum is much more complex than trying to gain refugee status. Due to the fact that it doesn’t involve the United Nations, applicants can be held in detention centers while their petitions are being evaluated. If they entered America illegally, then they can’t seek employment while they are applying for asylum. You have to wait a minimum of 150 days before your application can be processed.

Are family members eligible?

There are times when the eligibility of an individual affects the status of their family. Immediate family members may be allowed the same benefits when someone is granted asylum. Family members don’t need to be on American soil for the application to be approved and for them to gain entry. Individuals have the right to permanent residency one year after being granted asylum.

Refugee status

As with asylum, someone who is looking for refugee status does not currently reside on American soil. They don’t apply in the US, but to the UN High Commissioner for Refugees to get refugee status in America. All are run through the United Nations. If you want refugee status it doesn’t mean that you will be granted entry into America; you might be given refugee entry into another country. Therefore, individual cases aren’t determined by the American government; they only put quotas on how many refugees they will accept.
