Since DUI laws were first put into action, it’s likely that nothing has been so obscure as the issue of pot and intoxication. Law enforcement, dui attorney Aurora, other public defenders and even lab chemists are completely dumbfounded about how to create a quick and reliable test for marijuana intoxication in the field. What Nevada lawmakers are pretty certain about, however, is that the current methods used to measure intoxication for DUI when drugs are suspected are not an effective test.

Existing DUI laws related to pot currently test for “marijuana metabolites” in the urine. Any concentration in the bloodstream or urine that is higher than the minimum value has until now  been held as the gold standard to determine who was “high” while driving.

The problem is that two medical students from Touro University (California) may be debunking the entire practice by asking one critical question: “Are we really measuring for intoxication or some other arbitrary threshold?” The students told the Assembly Judiciary Committee last week that current testing for the presence or absence of the metabolites accepted as proof of intoxication in no way determines whether or not someone is high at the time of driving.

One of the students, Graham Lambert, testified in front of the Committee that the urine test was completely  unreliable when it came to proving that someone was intoxicated or impaired while driving. He urged those on the panel to do away with the test, which is currently legally justifiable in a court of law.

Graham believes that the test is not only unreliable but inaccurate, that it doesn’t measure what it intends to, that the metabolites aren’t reflective of any psychoactive effects for the person when tested, and those metabolites can remain active in the body for an unspecified number of days.

That means that a person can smoke pot two days before driving and still have the metabolites detected in their urine. But in no way does the presence of them prove that there were effects on a driver’s reasoning or impairment while driving.

The other student, Charles Collison, followed up Graham’s testimony by adding that the only psychoactive compounds found in pot are 11-OH-THC and Delta9-THC. Only those two compounds being present in blood has any bearing on a person’s impairment. If the students’ testimony stands as evidence, then testing methods used by the labs in Nevada to determine impairment from marijuana may be completely overhauled. The Assembly Bill 135 would completely alter the current state test performed in drug labs in relation to sobriety on the road.

This is not the first time that the current means of testing for marijuana metabolites has been in question. Former lab toxicologist Bill Anderson had testified in previous hearings that the metabolites were completely and totally irrelevant regarding impairment and intoxication.

Many lawmakers insist that if the goal of targeting intoxication is to stop vehicular accidents, then making sure you are measuring effectively is imperative to getting impaired drivers off of the road. By measuring metabolites you are doing nothing more than testing to see if someone has used marijuana in the recent past. That doesn’t indicate their current mental state or whether they chose to drive while intoxicated. So, the current method of testing is nothing more than a litmus test for pot use.

The good news is that if the lawmakers change the lab requirements, the labs are already equipped to handle the alteration. The labs themselves are already capable of isolating the compounds, so there is really no reason not to make the switch. With expert witnesses testifying to the certainty of measuring what is truly impairment and what is merely usage in the past, there is no reason not to pass the new bill to measure something reliable and hold people accountable for their actions.
