The Amtrak operator involved in the derailment crash that killed eight passengers and injured as many as 200 will face charges, even after the district attorney said that he wouldn’t. A judge has ordered that the operator be charged after two private criminal complaints were made for reckless endangerment. According to court documents and a personal injury lawyer, charges levied against him are for not only recklessly endangering his passengers, but also involuntary manslaughter.

Although a decision was made not to prosecute by the Pennsylvania Attorney General, a judge overturned it because he believed it was in the best interest of the public to pursue the case. Due to allegations of misconduct coming to light, the judge believes that action should be taken so that it doesn’t happen again in the future.

Prosecutors who made the decision not to press charges insisted that they simply didn’t have the necessary proof to make a case against Brandon Bostian for the accident. When Bostian accelerated to 106 mph around a curve that was supposed to be taken at 50, they didn’t believe that the circumstances would be tantamount to the recklessness or “conscious disregard” which would be necessary to proceed with the case.

The federal investigators believed that Bostian had not intentionally taken the curve too fast; instead he lost “situational awareness” of where he was along the track and mistakenly accelerated when he should not have. It was also found that he was not under the influence of drugs or alcohol, so it was seen as nothing more than a mistake on the part of an Amtrak operator. There was also no evidence that he was distracted in any way by a cell phone or other device.

Investigators concluded that they did not have any specific evidence that he was negligent for the accident. In train accident cases, there is a very high threshold necessary to press charges, and in this case, the prosecutor and investigators just didn’t believe they had all they needed to levy charges against Bostian.

Due to mounting personal injury suits waged by as many as 30 victims and their families, things have changed. Those involved in the personal injury suit against Amtrak insist that Bostian was negligent, and were very upset that no formal charges were going to be made. Many who remain totally disabled believe that he should not be let off without any punishment for his acts.

Bostian, who is now 34, is still on administrative leave with Amtrak and receives payment. Should he be convicted of charges or even intent charges, not only will he lose his job, but he could also face jail time. Those who believe that he is at fault think that is a fair consequence for their pain and suffering. Amtrak has agreed to a settlement in the amount of $265 million to the victims of the crash. Bostian himself has a personal injury suit against Amtrak, saying that he was struck by a rock while operating the train, which left him disoriented and unconscious. The NTSB, however, concluded that nothing hit the train and his claims are baseless. Those who know Bostian personally insist that he is suffering on his own with guilt and feels horrible. As an operator with experience in the field, there would be no reason for him to jeopardize his passengers by accelerating intentionally.

With the case now being handled on two different levels — civil and criminal — Bostian can either collect for the incident, or he can end up in prison. Although it was originally believed that he wasn’t going to be prosecuted, circumstances have changed, leaving his personal injury suit against Amtrak highly improbable.

Those who are still suffering maintain that if Bostian is allowed to walk — or worse yet, to collect for his injuries — when he was at fault for killing people then justice will not be served. Although they are already receiving financial compensation, victims are looking for some vindication and to ensure that this doesn’t ever happen again.
